Introduction

These Terms of Use ("Terms") govern access to and use of the websites, applications, and online platforms operated by 4EverMomentum LLC ("4EverMomentum," "we," "us," "our"), including the website at https://www.4evermomentum.com (the "Site") and the customer portal at https://customerportal.4evermomentum.com (the "Portal"). The Site and Portal are collectively referred to as the "Services." By accessing or using any part of the Services, you agree to be bound by these Terms and our Privacy Policy.

1. License and Acceptable Use

Subject to these Terms, 4EverMomentum grants you a limited, nonexclusive, nontransferable, revocable license to access and use the Services for lawful purposes. You agree not to:

Copy, distribute, or modify content from the Services without authorization
Interfere with the security or operations of the Services
Use automated means to access or extract data
Use the Services in violation of applicable law
Share account credentials or allow unauthorized access to your account
Submit false, misleading, or fraudulent information through the Services

2. Portal Accounts and Registration

Certain features of the Services, including the Portal, require you to register for an account. When registering, you agree to provide accurate, current, and complete information about yourself and your organization. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Account registration is subject to approval by 4EverMomentum. We reserve the right to approve, decline, suspend, or terminate any account at our sole discretion, including for inactivity, violation of these Terms, or any conduct we deem harmful to our operations or other users.

You must notify us immediately at Dispatch@4EverMomentum.com if you become aware of any unauthorized use of your account.

3. Orders and Transportation Services

The Portal allows authorized users to submit vehicle transport orders, obtain quotes, and manage shipments. All orders submitted through the Portal are subject to acceptance and confirmation by 4EverMomentum. Submission of an order does not guarantee acceptance.

Quotes and pricing presented through the Site or Portal are non-binding estimates. Pricing and availability are subject to confirmation and may change due to factors including vehicle condition, VIN decode accuracy, modifications, routing, market conditions, and timing. 4EverMomentum may accept, revise, or decline any quote or order at its sole discretion. No contract for transportation services is formed until expressly confirmed by 4EverMomentum.

You are responsible for the accuracy of all information provided with your orders, including vehicle details, pickup and delivery addresses, contact information, and special instructions. Inaccurate information may result in delays, additional charges, or order cancellation.

4. Payments

Payment processing is provided by third-party processors. You authorize the processor to charge the selected payment method and agree to comply with the processor's terms. 4EverMomentum is not responsible for third-party system errors or outages.

5. Intellectual Property

All trademarks, service marks, logos, text, graphics, software, and other content on the Services are owned by 4EverMomentum or its licensors and are protected by intellectual property laws. Unauthorized use is prohibited.

6. Disclaimers

THE SERVICES AND THEIR CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 4EVERMOMENTUM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS.

8. Indemnification

You agree to indemnify and hold harmless 4EverMomentum from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, misuse of the Services, or the inaccuracy of any information you provide.

9. Account Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including breach of these Terms. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) shall survive.

10. Governing Law & Venue

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules. Exclusive venue for any dispute relating to these Terms or the Services shall be in the state or federal courts located in Missouri, and you consent to personal jurisdiction there.

11. Changes to Terms

We may modify these Terms at any time by posting the revised Terms with an updated effective date. Continued use of the Services signifies acceptance of the revised Terms. For Portal users, material changes may also be communicated via email or in-app notification.
